Chel Diokno Needs To Analyze COVID-19 Quarantine Measures BEYOND Constitutional And Unconstitutional

Just because it's not in the constitution doesn't mean it's right or wrong, right? Then again Chel Diokno's argument may even be invalid. He's a human rights lawyer and does he know the CONTEXT of the 24 hours curfew in Muntinlupa? Just think about it that the 24 hours curfew is being set for? Is Diokno really considering what he just said?


Above is a screenshot from CNN Philippines which reveals the EXEMPTIONS of the current case. Those who are exempted are those part of essential service, those who need to buy basic commodities (though limited by one per household but I want to raise the limit to two), peace and order personnel, or going out only in EMERGENCY CASES. I wonder did Diokno even BOTHER to read? Granted, he's a lawyer and I'm just a nobody blogger so he should KNOW BETTER, right? Does Diokno really bother to understand the SEVERITY of the situation or does he not?

I think Diokno may want to argue with a doctor. For one, President Duterte consulted the Inter-Agency Task Force for the Management of Emerging Infectious Diseases (IATF-EID) on this matter. While I think Duterte could've started the temporary travel ban earlier (since China started theirs too) but let's credit him for actually doing something. I think IATF-EID may have given the suggestion for Muntinlupa's 24-hour curfew because it's a state of emergency. It's not a violation of the law of the land to give such a rule IF there's a state of emergency. If there's an ongoing war then isn't it advisable to stay at home except in applicable cases? If there's chaos then isn't it advisable to stay in your respective shelter? Has Diokno even considered any of that with what he just said? Diokno has the right to dislike Duterte but he should still keep his common sense intact.

Maybe what Diokno can do right now is if he can't contribute anything is to the QUARANTINE HIS MOUTH. If he has something to say then make sure it's something to help the quarantine. He has the right to question but he must also hear the other side's viewpoint. He has to consider that it's no longer an issue of constitutional or not. It's already a question of practical safety measures for the community in the ongoing COVID-19 outbreak. Does he want to get all this epidemic done and over with or not? If so then he needs to think beyond constitutional and unconstitutional and follow MEDICAL GUIDELINES ADVICE in the midst of the COVID-19 epidemic.

If not, Diokno may consider preparing his funeral plans at St. Peter's, maybe he can arrange for his cremation (which may be more advisable for those who died of COVID-19) in the case of his death, and maybe the Supreme Court can arrange for his ashes to be interred at the Libingan Ng Mga Bayani. Then again his internment may have to wait if ever he dies of COVID-19 during the quarantine period.
